Terms of Use The following are the terms that govern your use of the XO Tickets web site. By using the site, you agree to follow these terms. XO Tickets reserves the right to change these terms at any time, effective immediately, when the new terms are posted on the site.
All sales are final. Since tickets are a one of a kind, nonreplacable item, there are no refunds, exchanges or cancellations. Should your event be postponed, the tickets you have in hand will be honored for the rescheduled date. New tickets will not be issued. If your event is cancelled due to an act of god (rainout, earthquake, flood, etc), war or terrorism , you will recieve a full refund for the amount you paid for the tickets minus shipping and handling charges. In order to recieve a refund, TICKETS MUST BE RETURNED TO OUR OFFICE WITHIN 10 DAYS OF THE DATE OF CANCELLATION. XO Tickets will not issue exchanges or refunds after a purchase has been made for lost, stolen, damaged or destroyed tickets. When you recieve your tickets , keep them in a safe place. Please note, direct sunlight or heat can damage tickets.
The tickets on our site are guaranteed authentic. We thoroughly screen and check the references for every seller who lists tickets on XO Tickets. We stake our reputation on it.
Occasionally, the tickets you order may not be available at the time your order is recieved. If this is the case, an XO Tickets representative will contact you to discuss alternate seat locations.
All orders are shipped to the billing adress of your credit card. Exceptions to this must be approved by an XO Tickets representative. If you place an order and you have a need to ship to an adress other than your billing adress, please contact an XO Tickets representative by phone to discuss the situation after you place your order. Most orders are processed the same day they are recieved. Orders placed after hours will be processed the next business day. For certain events, tickets may not be available for immediate shipment. If this is the case an XO Tickets representative will contact you with notification of the approximate date the tickets will be shipped. All shipments require a signature at the time of delivery.
We are not the Box office. The Box Office is the term used to describe the original selling source for the tickets. We are an indpendent agency that buys and resells tickets to events on the secondary market. We apply a service charge to each ticket we sell, so the printed price on the ticket or the face value of the ticket will not be our selling price. Prices are determined by the market value of the ticket. In some cases, the market value of the ticket, determined by supply and demand, can be substantially higher than the face value of the ticket. The amount you pay over the face value reflects the cost of obtaining premium tickets.
All listed ticket prices are in US dollars and cents. Seats in all listed ticket groups will be together (consecutive, side by side) unless otherwise noted.
Except in jurisdictions where such provisions are restricted, in no event will XO Tickets be liable to you for damages, including lost profits. If there is any dispute involving the site.We participate in the Better Business Bureau's BBB OnLine Program. This means that we have committed to cooperating with BBB efforts to resolve disputes that may arise under this contract. Upon your request, we will agree to participate in a BBB dispute resolution process to resolve these disputes. There are limits as to the kinds of claims that the BBB will handle -- call the BBB of NJ for more information. You also agree that the dispute will be governed by the laws of the state of New Jersey without regard to its conflict of law provisions. You agree to personal jurisdiction by venue in the state and Federal Courts of the state of New Jersey.
You agree to indemnify and hold XO Tickets and its officers, agents, partners and employees harmless from any loss, liablity, claim or demand including reasonable attorneys fees, made by any third party due to or arising out of your use of the site.
